Civil Resilience

Contingency Planning Regulations 2005

  • The law

The Civil Contingencies Act 2004 (Contingency Planning) Regulations 2005, SI 2005/2042, were made by the Minister for the Cabinet Office on 22 July 2005 and came into force on 14 November 2005. Their explanatory note says they relate to "the extent of the duties imposed on certain persons and bodies (referred to as 'general Category 1 responders')" under sections 2 and 4 of the Act "and the manner in which those duties are to be performed".

Regulation 4 requires the general Category 1 responders in a local resilience area in England or Wales to co-operate in a single forum, named the local resilience forum, meeting at least once every six months. Regulation 5 makes the same provision for Scotland under the name strategic co-ordinating group. Regulations 9 to 11 identify a responder with lead responsibility for a duty. Regulation 14 lets ministers issue guidance or assessments on the likelihood and impact of emergencies. Regulations 15 to 17 require a community risk register. Regulation 23 requires responders to have regard to the activities of voluntary organisations. Regulations 27 and 30 require regard to "the importance of not alarming the public unnecessarily". Part 7 governs advice and assistance to business and voluntary organisations.

In practice

When a forum meets, publishes a community risk register or names a lead responder, it is doing what these Regulations require.
